50-Year Residential Surface Finish Limited Warranty
The surface finish for Flooring purchased for residential use is warranted by New Point USA not to wear
through or separate from Flooring under normal residential traffic conditions for 50 years from the date
of retail purchase so long as all care and maintenance instructed by NWFA are followed. Failure to care
for and maintain your Flooring pursuant to NWFA instructions may void this warranty. This “wear
through” warranty is subject to a standard trade allowance of up to 10 percent (10%) of the total
Flooring area and excludes stairs, meaning that such defects will only receive warranty protection if the
Flooring subject to the defects exceeds ten percent (10%) of the total Flooring purchased and installed,
and stairs shall not be covered at all.
Warranties Apply to the Original End-User Only
All Flooring warranties, including any implied warranties, apply to the original end-user of the Flooring
only. All warranty coverage terminates if you sell, transfer, or otherwise convey the Flooring or the
property to which the Flooring is attached.
New Point USA shall be permitted the opportunity to conduct or cause to be conducted any inspections
deemed reasonable or necessary by New Point USA on all warranty-related product claims, and the
claimant agrees to allow a reasonable sample of installed Flooring planks to be removed and taken for
analysis determined to be necessary by New Point USA.
Limited Lifetime Structural Warranty
New Point USA warrants all first-quality engineered hardwood floors, in their manufactured condition, to
be free from defects in material and workmanship, including milling, assembly, dimension, and grading.
New Point USA additionally warrants that these engineered hardwood floors will not delaminate when
properly installed and maintained according to New Point USA’s installation and maintenance
procedures.
What New Point USA Will Do
If the plies should delaminate due to glue bond failure, New Point USA will, at our option, either: (1)
repair the defective plank(s), or (2) replace the defective plank(s). This warranty is a limited lifetime
warranty for all first-quality New Point USA engineered products.
What New Point USA Will Do
In the event that the finish wears through or peels off of the hardwood flooring, New Point USA will, at
our option, either: (1) replace the affected plank(s), or (2) recoat the affected area.
NOTE: This limited warranty extends only for defects that cover at least 10% of the surface area of the
installed flooring. Gloss reduction, scratches, and dents in the finish are not considered surface wear and
are not covered under this warranty. Please note that maple, pine, and birch floors require extra care.
Maple and birch are inherently smooth wood and will show scratches and dents more readily than oak
or pecan. You should consider these factors when making your flooring selection.
Warranty Limitations (Applies to All Warranties Under Which New Point USA is or May Be Obligated)
New Point USA products are not warranted against squeaking, popping, or crackling. Some squeaking,
popping, or crackling is possible when using staple-down or nail-down installation methods. In addition,
New Point USA floors are not warranted against staple or nail pullout from the subfloor.
Limited Warranty for Manufacturing Defects
The limited warranty for Manufacturing Defects does not apply after the Warranty Holder has installed
the Flooring, and product variation or error that does not exceed the 5% industry standard is not
considered a Manufacturing Defect for purposes of this limited warranty. This limited warranty does not
extend to or cover:
Any damage, warping, cupping, buckling, grain raising, checking, splits, cracks, edge fracturing,
splintering, chipping, or any other defect to the Flooring caused by accidents, alterations, misuse,
abuse, direct exposure to the elements, or improper installation/maintenance.
Flooring damage resulting from failure to maintain the recommended humidity levels of 30-55% via
the use of a humidifier and/or dehumidifier and recommended temperature range of 60°-80°
Fahrenheit, as stated in the Maintenance Guide.
Flooring damage caused by moisture, excessive dryness, excessive heat or cold, negligence, water,
erosion, pets, insects, sanding, settlement or movement of the structure to which the Flooring is
attached, or installation of Flooring over an improper subfloor.
Damage caused by installation of the Flooring in highly fluctuating moisture or temperature
environments such as hot yoga studios.
Flooring damage caused by steam mops or wet mopping.
Flooring damage caused by moisture accumulation that leads to mold or mildew, including moisture
trapped below the Flooring that creates mold or mildew.
Flooring damage caused by moisture intrusions from concrete hydrostatic pressure, flooding, or
plumbing leaks, along with high levels of alkalinity.
Damage caused by fire, flooding, and other natural disasters.
Damage caused by vacuum cleaner beater brush or hard heads.
Damage caused by appliances, furniture, and casters.
Damage caused by cutting from sharp objects, tape, adhesive, or burns.
Damage caused by the use of non-approved cleaning products or methods such as wax, wood polish,
alkaline products, any abrasives, wet or steam mopping, etc.
Construction or installation-related damage (Examples: chips, dents, scratches, etc.).
Reduction in gloss, scratches, or indentation due to sand, pebbles, other abrasives, pets, insects,
construction traffic, or failure to maintain the floor as required.
Reduction in gloss or any finish distortion from removing any adhesives or chemicals.
Mold or mildew growth from over cleaning, steam mops, leaking pipes, or any other water sources.
Color, shade, or texture variations between samples or replacement flooring and the actual material.
Product warping, buckling, cupping related to any water-related occurrence (floods or extreme wet
mopping).
Fading or color change due to UV rays from direct sunlight.
Deficiencies related to subfloor/floor joist assemblies, subfloor preparation materials, and fasteners
including, but not limited to, uneven subfloor surfaces, floor deflection, or voids in the subfloor.
Floors installed over substrates with excessive moisture (MC/RH), and/or installed without an
approved moisture barrier/retarder
.Natural variations in color and characteristics such as grain patterns, knots, and mineral streaks may
occur within and between individual Flooring planks. Variations in color and character are not covered
under warranty. Flooring, especially when smoked/fumed or reactive stained, will change color over time
as a result of oxidation and UV rays. This color change is inherent and not a defect. This limited warranty
excludes color variation between orders, individual planks, and/or samples. New Point USA does not
warrant that the Flooring will match or coordinate with purchaser furnishings, trim, cabinetry, railings,
etc.
It is the installer’s responsibility to document all jobsite conditions and measurements, including the
installation date, site relative humidity, temperature, and subfloor moisture content at the time of
installation, and other documentation required under the Installation Guide. This Flooring must be fully
glued or nailed down and cannot be floated.
End-User Maintenance Responsibility
The end-user shall maintain the hardwood product in accordance with the Maintenance and Care
Information provided by New Point USA. Failure to do so may void this warranty.
This is the Complete Warranty
THIS IS THE COMPLETE WARRANTY AND IT IS IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES
AND CONDITIONS OF EVERY KIND, WHETHER CONTRACTUAL OR STATUTORY, ALL OF WHICH ARE
DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. Some states do not allow limitations on the
duration of an implied warranty, so the above limitation may not apply to you. This warranty gives you
specific legal rights, and you may also have other rights that vary from state to state.
Limitation of Damages
IN NO EVENT SHALL NEW POINT USA BE LIABLE UNDER THIS WARRANTY FOR SPECIAL, INCIDENTAL, OR
CONSEQUENTIAL DAMAGES EVEN IF NEW POINT USA HAS BEEN INFORMED, OR SHOULD BE AWARE, OF
THEIR LIKELIHOOD, OR FOR ANY OBLIGATIONS OR DAMAGES OTHER THAN THE SPECIFIC WARRANTY
SERVICE OBLIGATIONS EXPRESSLY SET OUT ABOVE. Some states do not allow the exclusion or limitation
of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This
warranty gives you specific legal rights, and you may also have other rights which vary from state to
state.
